Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and KG Enterprises, a sole proprietorship of Kyle Gilbrech ("we," "us," or "our"), governing your use of The Wandering Blade and the thewanderingblade.com website (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy and Refund & Virtual Goods Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service and make purchases only with the permission and supervision of a parent or legal guardian who agrees to these Terms. By using the Service you represent that you meet these requirements.

3. The Service & AI-generated content

The Wandering Blade is an interactive fantasy role-playing game whose "Game Master" narration, encounters, and outcomes are generated by artificial intelligence in real time. Because the content is AI-generated:

• It is dynamic and unpredictable, may contain fantasy violence and mature themes, and may occasionally be inaccurate, inconsistent, or not to your taste;
• It is provided for entertainment only and is not professional, legal, medical, financial, or other advice;
• We do not pre-screen every output and are not responsible for AI-generated content beyond what the law requires.

4. Your account

Your account is anonymous and tied to a token stored in your browser and on our server. You are responsible for the device and browser you use. Clearing your browser data may cause you to lose access to locally-stored progress; entitlements you have purchased can generally be restored when you reconnect, but freely-earned in-game items kept only in your browser may be lost. We are not liable for progress lost due to your device, browser, or actions.

5. Acceptable use

You agree not to:

• Abuse, overload, disrupt, or attempt to bypass rate limits, usage caps, or security of the Service;
• Reverse engineer, scrape, or use automated systems to access the Service except as expressly allowed;
• Use the Service to generate or distribute unlawful, infringing, or abusive content, or content that violates the acceptable-use policies of our AI provider;
• Resell, sublicense, or commercially exploit the Service or its content without our permission;
• Attempt to acquire in-game currency, turns, or entitlements other than through the Service's intended mechanics.

We may suspend or terminate access for conduct that violates these Terms.

6. Virtual goods & currency

The Service may let you obtain AI turns, "Platinum" premium currency, subscriptions, and other virtual items ("Virtual Goods"). Virtual Goods grant you a limited, personal, non-transferable, non-sublicensable, revocable license to use them within the game. Virtual Goods:

• Have no monetary value, are not your property, and are not redeemable for cash or anything outside the game;
• Cannot be transferred, sold, or exchanged between accounts;
• May be modified, re-balanced, or discontinued as we develop the game;
• Are forfeited without refund if your account is terminated for breach of these Terms or is deleted at your request.

7. Subscriptions, billing & automatic renewal

Some features are offered as recurring subscriptions (currently Adventurer, Hero, and Legend tiers, on monthly or annual plans) and some as one-time purchases (such as Platinum or turn packs). Payments are processed by Stripe.

• Automatic renewal. Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, and your payment method is charged, until you cancel. At checkout you provide express consent to these automatic-renewal terms before you are charged.
• What you're told before you pay. Before purchase you are shown the plan, the recurring price, the renewal frequency, and how to cancel.
• How to cancel (easy cancellation). You may cancel at any time — with no obstruction — using the manage-subscription link in your Stripe payment-confirmation email (which opens Stripe's customer portal), or by emailing us at TheWanderingBladeTavern@gmail.com. Cancellation stops future renewals; you keep access through the end of the period you've already paid for. Cancelling does not retroactively refund the current period (see the Refund Policy).
• Renewal & annual reminders. For annual (one-year) subscriptions, we will send a renewal reminder before each renewal and periodic reminders of your subscription, consistent with California's Automatic Renewal Law.
• Price changes. If we change subscription pricing, we will notify affected subscribers in advance as required by law before the new price takes effect, and you may cancel before it does.
• Free tier & limits. A free tier with daily usage limits is available and may change over time.

8. Intellectual property & your stories

The Service, including its software, artwork, systems, and branding, is owned by us and protected by law. We grant you a limited, personal, non-commercial license to use the Service. As for the stories the Game Master generates from your play: we don't claim ownership of your personal adventures and you may share them for personal, non-commercial purposes. Note that AI-generated output may not be eligible for copyright and that similar content may be generated for other players.

9. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW. You use the Service at your own discretion and risk.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KG ENTERPRISES AND KYLE GILBRECH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROGRESS, OR VIRTUAL GOODS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless KG Enterprises and Kyle Gilbrech from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service at any time and may delete your data from within the game. We may suspend or terminate access if you breach these Terms or to protect the Service. Sections that by their nature should survive termination (including Virtual Goods, disclaimers, liability limits, and governing law) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California will have jurisdiction, except where applicable law gives you the right to bring claims elsewhere. Before filing any claim, you agree to first contact us at TheWanderingBladeTavern@gmail.com so we can try to resolve it informally. Nothing in these Terms waives any non-waivable statutory rights you have as a consumer.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows the current version, and continued use after changes means you accept them.
